Pune Porsche deaths: JJB bail order requires minor driver to write essay on accident
PTC News Desk: Hours after his Porsche car struck a motorbike, killing two people, the Juvenile Justice Board (JJB) in Pune ordered a young driver to work with traffic police for fifteen days and write an essay about the event. The board also granted the youngster bail.
Early on Sunday in Pune’s Kalyaninagar, the deceased were riding their two-wheeler when a speeding Porsche struck their bike from behind. Following the collision, which was reported in the Kalyaninagar region at around 2:30 am, a charge was filed under the applicable sections of the Indian Penal Code (IPC) against the 17-year-old child driver.
The young person is the offspring of a well-known city real estate entrepreneur, whose Porsche was operating without a license plate.
The driver’s father has also been charged by the police, and the pub faces legal action for providing alcohol to a juvenile.
Police presented the youngster to the Juvenile Justice Board (JJB) on Sunday night after his apprehension, arguing that the driver should face an adult trial. The JJB, however, rejected the plea and granted bail under specific guidelines.
Prashant Patil, the minor’s legal representative, claims that the juvenile’s bail order from JJB requires his client to work with Yerawada traffic police for a duration of fifteen days and requires the accused to submit an essay about an accident.
According to Patil, the child should also seek out psychiatric counseling and receive treatment from a physician who can assist him in quitting drinking. A report from this therapy must be turned in.
“At Yerawada police station, my client was being held in relation to a recorded matter. My client was kindly granted bail by the Honorable Court, subject to specific requirements. We will keep working with the police agencies because we have total faith in the inquiry. My client has an obligation to adhere to the strict guidelines set forth by the Honorable Court. We’ll be here for the procedures and we’ll wait to hear the investigation’s conclusion,” attorney Patil declared.
Authorities stated that they believe the young driver was intoxicated, and in order to confirm this, they sent him for a medical check, the results of which are now pending.
Anis Awadhiya, 24, and Ashwini Costa, 24, who are both from Madhya Pradesh and engineers by trade, have been identified as the victims.
After a gathering at a restaurant in the same area as the accident, the deceased were allegedly riding their motorcycles home.
Before he departed a few days ago, Ashwini and Anis, a BE Computer, were coworkers in a multinational business in Kalyaninagar, where Anis worked as an engineer.
A speeding Porsche struck one of the motorcycles as the deceased approached the Kalyaninagar intersection, sending both riders from the vehicle and into the first information report (FIR), a copy of which HT has seen. According to the FIR, both victims passed away instantly.
The car struck the pair, then struck another vehicle and slammed into the roadside pavement barriers, causing significant damage.
On social media, the crash footage became viral. In addition, a group of individuals can be seen on camera allegedly beating the driver while he was trying to get out of the wrecked car and then giving him over to the police.
“We have taken the juvenile who was operating the vehicle into custody and are having him examined medically to see whether he has had any alcohol. The motorcycle rider and pillion perished instantly when the automobile he was driving crashed into the back end of the two-wheeler, according to deputy police commissioner Vijay Kumar Magar.
Pune police commissioner Amitesh Kumar pointed to the Juvenile Justice Act’s provision and stated that the minor’s father and the institution that served alcohol will face consequences.
According to Sections 75 and 77 of the Juvenile Justice Act, legal action is being taken against the accused’s father and the bar that gave the minor alcohol. Police are currently looking into the bar he went to and drank at, according to Kumar.
The child was travelling from Koregaon Park to his home in Brahma Sun City when he was involved in an accident, according to the investigation.
Primarily, it appears that this is an instance of driving under the influence, stated Manoj Patil, the East Region’s Additional Commissioner of Police. Currently, the minor is being held under Section 304, and other formalities related to medical care and other matters are being completed.
Sections 279 (rash driving or riding on a public way), 304A (causing death by a rash or negligent act not amounting to culpable homicide), 337 (causing hurt by an act so rash or negligent as to endanger human life or personal safety of others), and 338 (causing grievous hurt by an act endangering life or personal safety of others) are among the IPC sections under which the minor driver has been charged at the Yerawada police station.
Manoj Patil, additional commissioner of police (east region) said, “Prima facie it seems that this is the case of drunk and drive. As of now, we have detained the minor under sections of 304 and medical and other further formalities are going on.”
