Delhi High Court stays trial court’s bail order for Arvind Kejriwal
PTC News Desk: Arvind Kejriwal, the national convenor of the Aam Aadmi Party (AAP) and the chief minister of Delhi, will remain behind bars after the Delhi high court granted the Enforcement Directorate’s (ED) appeal against a trial court’s decision to grant him bail in a money laundering case involving an excise policy that has since been discontinued.
The high court declared that the trial court’s conclusion that the copious amount of evidence provided by the ED could not be taken into account was “totally unjustified.”
A vacation bench of Justice Sudhir Kumar Jain stated, “The trial court’s observation that extensive material cannot be considered is totally unjustified and it shows that the trial court has not applied its mind to the material.”
In its ruling, the high court also pointed out that the vacation judge had not given the twin requirements of Section 45 of the Prevention of Money Laundering Act (PMLA) any thought.
