ED petitions Delhi court to extend Arvind Kejriwal’s judicial custody
PTC News Desk: In the money laundering case pertaining to the now-canceled Delhi liquor excise policy, the Enforcement Directorate filed a motion on Monday in Delhi’s Rouse Avenue Court asking for an extension of chief minister Arvind Kejriwal’s judicial custody.
The agency informed the court that Kejriwal is on provisional bail at the moment and has been ordered to turn himself up on June 2. The application is kept pending by the court and is scheduled to be heard on June 2.
On May 10, the Supreme Court granted Kejriwal interim bail. Kejriwal was arrested on March 21 by the ED in connection with the agency’s money laundering investigation into the now-canceled Delhi excise policy. Kejriwal is not permitted to attend the Delhi Secretariat or the Office of the Chief Minister, according to an order from the highest court.
On June 2, the day following the general election’s final round of polling, he will have to turn himself in and return to prison.
Kejriwal and the Aam Aadmi Party were listed as suspects in the excise policy investigation by the ED on Friday in their most recent chargesheet. “Kejriwal is the key conspirator who used his position as the Chief Minister of Delhi to facilitate the offence of money laundering punishable u/s 4 of PMLA (prevention of money laundering act) by the ‘company’ i.e. AAP,” an official told HT, citing a detailed chargesheet based on “irrefutable evidence.”
The Election Department (ED) has previously stated that the AAP, being a political party, can be classified as a “company” as defined by section 70 of the PMLA since it is an association or a body of individual residents of India under the Representation of the People Act.
In the concurrent case filed by the CBI, the court also granted BRS Leader K. Kavitha an extension of his judicial custody until June 3.
The excise case concerns allegations of money laundering and corruption during the development and implementation of the excise policy for 2021–2022 by the Delhi government, which was subsequently abandoned.
